What is the process of impeachment?


Oklahoma Constitution - Article VIII, Section 1

Impeachment and Removal From Office - The Governor and other elective state officers, shall be liable and subject to impeachment for willful neglect of duty, corruption in office, habitual drunkenness, incompetency, or any offense involving moral turpitude committed while in office.

  1. House of Representatives creates resolution for articles of impeachment via committee process

  2. House of Representatives body votes - needs simple majority of members present (51%)

  3. Senate has 10 days to act on House of Representatives articles of impeachment

  4. Chief Justice of OK Supreme Court serves as presiding judge

  5. Senate is seated as jury with final voting power

  6. House of Representative appoints select members as trial prosecutors 

  7. Senate body votes for impeachment - needs 2/3 majority of Senate present to impeach

  8. Senate body votes for removal from office - needs 2/3 majority of Senate present to remove

What happens next?

The Governor appoints a temporary replacement until next General Election.
